Contest: RadioShack Loves Pinball!

In honor of the lifting of the Pinball Ban in Oakland, California, RadioShack and Stern Pinball are teaming up to give you a chance to win your very own machine!  Do you have what it takes to bring the competition down?  Come to the RadioShack in Fruitvale Station between August 20th and September 19th, 2014, to play your best round on the Iron Man machine.  Those who hit 50,000,000 are qualified for the finals, and the high score out of those contenders gets to bring this bad boy home.  Of course, there are a few rules that have to be followed (see below).

Terms and Conditions

 

NO PURCHASE NECESSARY TO PARTICIPATE. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF RECEIVING AN AWARD.

CHALLENGE PERIOD: The RadioShack Loves Pinball Tournament Challenge (the “Challenge”) will take place at the RadioShack Fruitvale Station retail location at 3040 East 9th Street Suite A, Oakland, California 94601 (the “Challenge Location”) during standard operating hours starting 9:00 a.m. Pacific Time (“PT”) on August 20, 2014 and ending at 9:30 p.m. PT on September 19, 2014 (the “Challenge Period”). Standard operating hours at the Challenge Location are 9:00 a.m. PT to 9:30 p.m. PT Monday to Friday, 9:00 a.m. PT to 9:00 p.m. PT Saturday and 10:00 a.m. PT to 7:00 p.m. PT Sunday.

ELIGIBILITY: The Challenge is open to legal residents of the fifty (50) United States and the District of Columbia who are 18 years of age or older at time of entry. Employees of RadioShack Corporation (the “Promoter”), Weber Shandwick, and their respective parents, subsidiaries, affiliates, retailers and advertising and promotion agencies, and each of their immediate family members (spouse, parent, child or sibling, and their respective spouses, regardless of where they reside) and individuals living in the same households of each of these individuals, whether or not related, are not eligible to participate. Challenge is subject to all applicable federal, state and local laws.

HOW TO PARTICIPATE: During the Challenge Period, visit the Challenge Location where an official Stern Iron Man Pro Vault Edition pinball machine (the “Game”) will be available to play free of charge. The Game will be set to a 3-ball Tournament Mode setting and will be available on a first-come, first-serve basis. Promoter does not guarantee the availability to play the Game.Your score in the Game will increase based on your skill. In the event you score higher than 50,000,000 during one (1) game play, you will be required to notify a RadioShack  representative who will verify your score and obtain your potential qualifier information. Important Note: If you score higher than 50,000,000 and do not notify a RadioShack representative and the Game display resets for a new game, such game play will no longer be considered as a potential qualifier. If you do not score 50,000,000 or higher, your game play will not be considered. Game plays by any means which subvert the game plays process or are otherwise obtained in a manner that is not in compliance with these Terms and Conditions will be void. All game plays must be done in accordance with Promoter’s instructions and completed during the Challenge Period. Promoter’s decisions are final and binding on matters relating to this Challenge.

QUALIFIER DETERMINATION: At the end of each day throughout the Challenge Period, a leaderboard with the top sixteen (16) qualifying scores to-date will be updated and displayed on the RadioShack TechSpecs blog at http://blog.radioshack.com/.Once the Challenge Period has concluded, the sixteen (16) participants with the highest qualifying scores will qualify to participate in the Grand Finale (described below). Any/all transportation to the Grand Finale will not be provided and will be the sole responsibility of each qualifier.

GRAND FINALE: The Grand Finale will take place at the Challenge Location on September 20, 2014. Qualifiers will play the Game and compete in a head-to-head competition that will be in a single game play elimination format (i.e., 1st seed vs. 16th seed, 2nd seed vs. 15th seed). The one (1) participant remaining at the end of the single game elimination Grand Finale will be deemed the potential award recipient. Promoter reserves the right not to provide the award if, in its sole discretion, it does not receive a qualified score during the Challenge Period. Award receipt is subject to verification of eligibility and compliance with these Terms and Conditions.

AWARD (1): An official Stern Iron Man Pro Vault Edition pinball machine and a $2,500 check which may be used to defray the tax liability on the award. Approximate Retail Value (“ARV”): $7,500.

AWARD CONDITIONS: All award details are at the sole discretion of the Promoter. No substitution or transfer of award (or portion thereof) permitted by award recipient. Promoter reserves the right to substitute award with one of comparable or greater value, at its sole discretion. All federal, state and local taxes, and all costs and expenses related to the acceptance and use of the award not specified herein as being provided are the sole responsibility of the award recipient. Award will be provided “as is” with no warranty or guarantee, either expressed or implied by Promoter. Pinball machine will be shipped to winner’s residence within 3-4 weeks from Grand Finale date.

AWARD RECIPIENT DOCUMENTATION: Promoter’s decisions are final and binding on all matters relating to this Challenge. Potential award recipient will be required to complete an Affidavit of Eligibility, Liability and Publicity Release (unless prohibited by law) and any other documents required by Promoter, which must be returned within five business days of date appearing on award documentation. Failure to sign and return requested documentation within the specified time period, the inability of Promoter to contact a potential award recipient within a reasonable time period or noncompliance with these Terms and Conditions by potential award recipient will result in disqualification and, at Promoter’s sole discretion, the award may be provided to a runner-up.

GENERAL: By participating, participants agree (a) to be bound by these Terms and Conditions and the decisions of the Promoter, which are final and binding in all matters; (b) to the use by Promoter and their designees of their names, cities and states of residence and likenesses for advertising, promotional and other purposes in any and all media now or hereafter known throughout the world in perpetuity without additional compensation, notification or permission, unless prohibited by law; and (c) to release, discharge and hold harmless Promoter, Weber Shandwick, and their respective parents, affiliates, subsidiaries, retailers, distributors, suppliers, advertising and promotion agencies, and any other individuals engaged in any way in the development, production, printing, distribution or execution of this Challenge, and the respective directors, officers, and employees of the foregoing (collectively, the “Released Parties”) from any liability, claims, losses and damages arising out of or relating to their participation in this Challenge and the acceptance, use, misuse or possession of any award received. Released Parties are not responsible for lost, late, stolen, damaged, inaccurate, incomplete, or counterfeit game plays, points, scores, or data corruption, theft, destruction, unauthorized access to or alteration of game plays, points, scores, loss or otherwise. Released Parties are not responsible for any other errors, malfunctions or problems of any kind, whether printing, typographical, technical, human or otherwise, errors or problems relating to or in connection with this Challenge, including, without limitation, errors, malfunctions or problems which may occur in connection with the administration of the Challenge, the use of the pinball machine, the announcement of the award, the tabulation of points and scores, or in any Challenge-related materials. Promoter reserves the right, at their sole discretion, to modify or terminate this Challenge, should any technical failures, unauthorized human intervention or other causes corrupt or affect the administration, security, fairness or proper conduct of the Challenge. Promoter reserves the right, at their sole discretion, to disqualify any participant from this Challenge or any other promotion conducted now or in the future by Promoter or any of their affiliates if his/her fraud or misconduct affects the integrity of the Challenge or who is otherwise in violation of these Terms and Conditions, as determined by Promoter in their sole discretion, and void all associated game plays. You are not an award recipient until your eligibility has been verified, and it is determined that you have complied with all terms of these Terms and Conditions. ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CHALLENGE IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, PROMOTER RESERVES THE RIGHT TO SEEK ANY AND ALL REMEDIES AVAILABLE (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

ARBITRATION: Except where prohibited by law, as a condition of participating in this Challenge, participant agrees that (1) any and all disputes and causes of action arising out of or connected with this Challenge, or any awards provided, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held at the AAA regional office nearest the participant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e., costs associated with participating in this Challenge), and participant further waives all rights to have damages multiplied or increased.

CHOICE OF LAW: All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of participant and Promoter in connection with the Challenge, shall be governed by, and construed in accordance with, the substantive laws of the State of Texas, USA.
